New temporary pavement licences

To assist the hospitality sector in its recovery, the Government has introduced a new type of Temporary Pavement Licence under The Business and Planning Act 2020.

This new type of licence establishes a quicker and lower cost option for businesses to obtain permission from the council to place tables and chairs outside their premises on the pavement (and certain other types of Highway where vehicles are restricted such as pedestrian zones).

The government has also produced some guidance for businesses, which can be found on the government website.

Following extensions in 2021 and 2022, a further amendment to the act came into force in Summer 2023 extending the provision of Temporary Pavement Licences (TPLs) until 30 September 2024.

This does not affect any current licences which will still expire as normal on 30 September 2023.

It is not possible to renew a TPL, but new applicants and current licence holders are free to apply for a fresh licence, which will expire on 30 September 2024.
