Creation of new public highways: Section 38 agreements

Fees and charges

Developers have to pay for s38 agreements.

Prior to technical approval, an application charge of £150 is required to check the application pack contains all the required documentation.

This fee includes one more corrected submission to be allowed before further application charges are made.

The minimum technical approval and inspection fee of £14,355* will always apply for schemes over £15,000 construction value.

Schemes below £15,000 will be priced on an individual basis.

Additional fees may also be applicable: you will be advised of additional fees during the application process, and possible charges can be viewed on the 2024 to 2025 fees and charges list (relevant charges begin on page 233).
