Out-of-time witness statement

If you did not send a witness statement within 21 days of receiving the Order for Recovery, you can apply to submit one late. This is called an out-of-time witness statement.

If the Penalty Charge Notice (PCN) was sent to your old address and you did not receive it, include your current address in your application.

How to apply

You must complete 2 forms:

  • Form TE7: Apply for more time to challenge a traffic enforcement order
  • Form TE9: Challenge a traffic enforcement order

What happens next

When the Traffic Enforcement Centre (TEC) receives your application, your case will be put on hold until a decision is made.

The TEC will decide whether to accept or reject your application.

  • If your application is accepted, the TEC will issue a Revoking Order. This does not cancel the original PCN.
  • If your application is rejected, the TEC will issue a Refusal Order.
