Notice of the Commencement of the Period for the Exercise of Public Rights

The Accounts and Audit (Amendment) Regulations 2022

The Council is required by The Local Audit and Accountability Act 2014 and the Accounts and Audit Regulations 2015 to present its Statement of Accounts (and associated documents) for public inspection for a period of 30 working days.

The Department for Levelling Up, Housing and Communities has extended the statutory deadlines for local authorities to approve and publish their 2021 to 2022 accounts.

The revised deadlines applicable to local authorities are as follows:

  • Approve Draft Accounts 31 July (previously 31 May).
  • Public Inspection Period to start on or before the first working day of August (previously included first 10 working days of June).
  • Publish Final Audited Accounts 30 November (previously 31 July).

The Accounts and Audit (Amendment) Regulations 2022 have implemented these new deadlines by amending the Accounts and Audit Regulations 2015.

Birmingham City Council Statement of Accounts: Financial Year 2021 to 2022

The Council's Draft Statement of Accounts which includes Group Accounts, the Narrative Statement and the Draft Annual Governance Statement was signed by Rebecca Hellard, Director of Council Management, the Chief Finance Officer and Section 151 Officer on 28 July 2022 and passed to Grant Thornton UK LLP for external audit on 29 July 2022.

NOTICE OF PUBLIC RIGHTS

NOTICE is given that the Draft Statement of Accounts for the year ended 31 March 2022 has been published on the council’s website. The Draft Statement of Accounts is unaudited and may be subject to change.

The period for the exercise of public rights commences 10am on 1 August 2022 and will conclude on 12 September 2022 at 4pm.

Local electors can request a copy of the draft accounts sent to them either by writing to Annette Rowe, Council Management Directorate, Finance (WS), PO Box 16306, Birmingham B2 2XR, or by emailing annette.rowe@birmingham.gov.uk or by telephoning 0121 303 3313.

Access to view a copy of the draft accounts in person at 10 Woodcock Street will only be available by prior arrangement. Contact us via one of the channels above to discuss this, if you are unable to access a copy of the draft accounts by any other means.

During this time, you can also see supporting documents including books, contracts, bills, vouchers and receipts, and ask for copies of these or of the accounts. However, the law does not give you a right to see documents which are protected by commercial confidentiality or to see personal information relating to an individual.

NOTICE is given that from 1 August 2022 to 12 September 2022, a local government elector for any area to which the accounts relate, or their representative, may question the auditor about the accounts, as set out in Section 26 of the Local Audit and Accountability Act 2014.

NOTICE is given that from 1 August 2022 to 12 September 2022 any such elector may make objections to the auditor, under Section 27 of the Local Audit and Accountability Act 2014, relating to any matter where the auditor could take action under:

  • Section 28 of the Local Audit and Accountability Act 2014, namely, to apply to the court for a declaration that an item in the accounts is contrary to law, and/or
  • Section 24 and paragraph 1 of Schedule 7 of the Local Audit and Accountability Act 2014, namely, to make a report in the public interest.

No objection may be made unless the auditor has previously received written notice of the proposed objection, specifying the facts on which the objector relies and the grounds on which the objection is being made.
