Under the terms of the Data Protection Act 1998 you can ask us for copies of personal information we hold about you as an individual.     • Subject Access Request. Sections 7 to 9 of the Act gives an Individual the rights to request access to any 'personal data' that they believe may be held about them.

    • No, but the more specific you are in relation to the area’s within the Council the data may be held, will enable us to deal with your request more effectively.

    • Yes, the legislation states that we can make a charge of £10 for a subject access requests. However, the Council currently process these requests free of charge.

    • The information requested will be provided promptly and in any event within 40 Calendar days of receipt of the subject access request. If the information cannot be disclosed within the time period specified, the data subject will be kept fully informed of the process and given access to any personal data that may already have been gathered.

    • There is no reason the data subject cannot make a request through an agent. If the data controller who receives such a request is satisfied that the individual has authorised the agent to make the request on their behalf. This might for example, consist of a written authority signed by the individual or a general power of attorney given by the individual. It will be the agent’s responsibility to produce satisfactory evidence that they have this authority.
