Licensing - Prosecutions

At their meeting in May 2005 the Licensing Committee agreed to publicise cases taken by the City Council insofar as these relate to offences committed in respect of the Licensing Service. The list below identifies cases taken between August 2012 - February 2013 and this will be updated on a monthly basis following consideration of the report on this matter by the Licensing Committee each month.

Only cases taken over a six month period will remain on this web page. The page will be reviewed regularly with older cases being deleted on this basis.

Tahir Hussain
Pleaded not guilty at Birmingham Magistrates Court on 8th August 2012 to two offences: one of plying for hire on Bromsgrove Street and one of having invalid insurance. Found guilty after trial.

Akbar Wazir
Pleaded not guilty at Birmingham Magistrates Court on 31st August 2012 to six offences. Two offences of driving without insurance on two separate occasions. Four offences of having in his possession articles for use in connection with or in
the course of a Fraud, namely a private hire vehicle licensed by the City Council and private hire driver’s badge in the name of Mohammed Wazir. Found guilty after trial.
Sentence: 26 weeks imprisonment suspended for 2 years, 300 hours unpaid work, 6 months supervision to deal with victim
awareness & disqualified from driving for 12 months.

Mohammed Wazir
Pleaded not guilty at Birmingham Magistrates Court on 31st August 2012 to six offences. Two offences of permitting Akbra Wazir to use a motor vehicle without valid insurance. Four offences of supplying Akbar Wazir with articles, namely a private hire vehicle and his private hire driver’s badge intending it to be used in the commission of a fraud.Found guilty after trial.
Sentence: 26 weeks imprisonment suspended for 2 years, 300 hours unpaid work, 6 months supervision to deal with victim
awareness & disqualified from driving for 12 months.

Jibran Nisar Ahmed
Pleaded guilty at Birmingham Magistrates Court on 13th September 2012 to four offences. Three offences of failing to keep proper journey records in the prescribed manner and one offence of failing to produce documents to an authorised officer when requested to do so.

Mohammed Ghouse
Pleaded guilty at to seven offences. One offence of having in his possession an altered private hire journey book for use in the course of a Fraud. Five offences of failing to produce accurate records relating to private hire drivers and one
offence of failing to comply with a request by an authorised officer to produce driver records and supporting documentation.
Sentence: 12 months community order with 100 hours unpaid work.

Pleaded guilty at Birmingham Magistrates Court on 9th November 2012 to one offence of making a false statement in connection with an application for the transfer of a premises licence relating to Curry Garden Restaurant, 16 York
Road, Erdington. The application was supported by a document which claimed to be signed by Mr Abdul Motin, the existing licensee. Mr Motin had not signed the consent to transfer the licence.

Mandy Wade & Richard Wade
Mrs Wade pleaded guilty at Birmingham Magistrates Court on 15th January 2013 to two offences of being the operator of Brookfleet Cars and failing to produce the Operator’s licence and records of drivers and vehicles operated by
the company. Mr Wade pleaded guilty to seven offences of being the Manager of Brookfleet Cars and failing to produce the licence to officers, failing to produce records relating to private hire drivers and vehicles operated by the company, failing to produce records of bookings and failing to produce a current MOT certificate for one of the vehicles. He also provided false information to officers stating that the company were not trading and that they did not operate Birmingham licensed drivers.
