Planning & Property Law

Stuart Evans is Head of Planning & Property Law and leads two distinct teams.

Stuart has considerable local authority experience and specialises in Town and Country Planning Law and Environmental Law. He is a member of the Law Society Specialised Planning Panel. Stuart also advises Planning Committee and Public Protection Committee on legal and governance issues. He is also the relationship lawyer for the Development Directorate. Stuart has a lead role in the department's external work through LSB Law.


  • deals with all aspects of Planning Highways Law, Footpaths Law, law relating to Leisure Services, Licensing, Data Protection, and Freedom of Information issues in relation to all these areas as well as dealing with general advice and all necessary agreements
  • has a number of specialist lawyers in all areas of information law matters, all licensing issues, Byelaws, Tree Preservation Orders and Village Greens and Contaminated Land Law Issues
  • specialises in Advocacy at Public Inquiries
  • has regular contact with the public, Members and Officers in relation to Committee matters
  • focuses on supporting the Development Directorate, Environment and Culture and Regulatory Services, including licensing


  • deals with all development sales, complex, joint venture and commercial property transactions both with the public and private sector
  • deals with complex property management issues, leases to the council and provides property support to other corporate teams to enable them to deliver corporate projects involving property
  • deals with routine property transactions of sales and purchases
  • deals with Public Private Initiatives, Building Schools for the Future, including the Academies programme as well as assisting the Housing Department in the repairs and maintenance contracts and the Municipal Housing Trust
  • deals with the majority of the routine Landlord and Tenant work of the council both commercial and residential, including Right to Buy and Leasehold Reform Act matters
  • assists other property teams with title investigation and research
  • supports the Regeneration Team in the property elements of compulsory purchase
  • deals with major transformation projects, including Building Schools for the Future , the Academies Programme and grant funding for major housing projects via the Homes and Community Agency for Birmingham Municipal Housing Trust and the Public Land Initiative
  • has unique expertise and experience in Compulsory Purchase Orders, including dealing with the Bull Ring and now New Street Gateway projects
  • is experienced in working across legal disciplines and in partnership with the private sector
  • has a wide knowledge of a range of local government areas and other public sectors
  • is skilled at collaboration and team work
