Street Trading - Occasional Market or Fair

 Love Your Markets

To hold an occasional market or fair, including antique, coin, stamp, postcard, book fairs etc within the City of Birmingham

COMMERCIAL

Prior permission of Birmingham City Council must be sought before holding an occasional market/fair. Outdoor markets/fairs will not normally be permitted but special permission may be granted for some stalls in certain circumstances on application. There will be no limit for an operator on the number of one or two weekday fairs, subject to the restrictions on the number of stalls referred to below. A limit on stalls per month will normally apply. However this can be varied by special permission, having given at least two months' notice. The following conditions apply :-

- at least 28 days notice of intent must be given, 2 months for more than 50 stalls.

N.B. The holding of a market other than in a building without giving the requisite notice renders both the operator and the occupier of the land liable to prosecution under Section 37 of the Miscellaneous Provisions Act 1982

- a licence fee of £163.80 is payable on application and this must be received at least 28 days before the event
- a fee of £2.00 for each let stall or space of up to 8' frontage and £2.00 per 8' run or part thereafter, over the permitted 50 stalls
- the actual fee will be determined no later than 7 days after the event, either on receipt of a Market Officer's report OR if the event is not inspected, by the operator informing the Street Trading, Markets Division on the number and size of stalls let

Any organisation or individual found to be contravening the above requirements may be prosecuted and/or banned from holding further events.


CHARITABLE

A limit on stalls per month will normally apply. However this can be varied by special permission, having given at least two months' notice. The following conditions apply :-

- at least 28 days notice of intent must be given

N.B. The holding of a market other than in a building without giving the requisite notice renders both the operator and the occupier of the land liable to prosecution under Section 37 of the Miscellaneous Provisions Act 1982

- a licence fee of £54.60is payable on application and this must be received at least 28 days before the event
- any stalls let a bove 50 will be charged at £1.00 per unit. Unless prior agreement has been granted, the letting of excess stalls could jeopardise licensing of future events
- evidence, to show that all income from stall lettings has benefited the organisation identified in the application, must be available for inspection on request, together with information on the number of stalls let. If such evidence is not available, operators may be required to pay the full commercial rate of £2.00 per stall let

Any organisation or individual found to be contravening the above requirements may be prosecuted and/or banned from holding further events.
