How to appeal

This page gives you information about how to appeal against a decision to refuse your child a school place. There are different types of appeal, for further information please refer to the booklet at the bottom of this page “A Parents Guide to the Appeal Process”.

At the time of the Secondary School offer of places in March 2013 and the offer of Reception Class places in April 2013, most Birmingham parents / carers who applied on time were offered one of their preferred schools:

  • 94.9% of Birmingham applicants for transfer to Year 7 were offered one of their preferences
  • 95.8% of Birmingham applicants for Reception Class were offered one of their preferences

However, there are a small number of cases each year where the school cannot offer a place. If this happens to you, the School Admissions and Pupil Placements Service can give you information on other schools that may have places available. (See contact detail in the essential information section)

If you feel you would like to pursue the matter further, you can have your case heard by an Appeal Panel that is independent of the Local Authority or, in the case of foundation or voluntary aided schools and academies, by an Appeal Panel that is independent of the school’s admission authority.

You should not wait for the outcome of an appeal about one school before deciding to appeal about another as appeals can be made for more than one school at the same time.

Parents who have appealed unsuccessfully for a particular school cannot appeal again for a place at the same school, in the same academic year, unless there have been significant and material changes in their circumstances.

Appeals for schools outside Birmingham should be made in accordance with the published admission arrangements of the local authority concerned.

    If you are appealing for a school place for a child in any other year group, or for a Year 7 place after the start of the school year, there is no deadline for submitting your appeal. However, please note that it can take up to 6 weeks for appeal hearings to be scheduled.



  • Approximately 0.5% of appeals for entry to Reception Class in September 2012 were successful. Overall, around 1.5% of all appeals for primary school places, heard in 2011/12, were upheld.

  • The statutory limit on class sizes in infant classes restricts the circumstances in which an Appeal Panel may uphold an appeal where the admission, would exceed the class size limit of 30 pupils with a single qualified teacher. For Reception, Year 1 and Year 2, an Appeal Panel can only uphold an appeal if it is satisfied that:

    • your child would have been offered a place if the published admission arrangements had been properly implemented

    Or

    • your child would have been offered a place if the arrangements had not been contrary to the school admissions code and the legislation

    Or

    • the decision was not one which a reasonable admission authority would make in the circumstances of the case

    Please note that while you may talk about personal factors at an infant class appeal hearing, the Appeal Panel cannot take personal factors into account unless they are relevant to one of the three points above.

  • If you want to appeal against a decision not to offer your child a place at a voluntary aided or foundation primary school or at an academy, you should write to the Chair of the Governors at that school or academy.

Frequently Asked Questions
    • You should include any reasons why you feel your child should be offered a place at your preferred school. You may wish to support your appeal by providing other evidence such as a letter from a professional.

    • You can only appeal for schools that you have included as a preference.

    • The Appeal Panel is completely independent and the decisions they make are legally binding on the local authority, the school and on you.
