Local Land Charges

Overview

Land Charges are searches of property history. They take place when a property is changing hands, usually by solicitors acting on behalf of the purchasers. Searches are submitted to us and we provide information about planning applications, building regulation applications, enforcement activity, conditions or other charges on the property or land being sold.

Essential Information
  • To make it easier for people to submit their own searches, we have created a Quick Search Form (see below). This is a shortened version of the standard (LLC1 and Con29) forms.

    We are however, happy to receive search requests on the standard forms via Post, NLIS or email.
  • By Email:-
    land.charges@birmingham.gov.uk giving the address, telephone number, any references and a written undertaking to place a cheque for £100.00 in the post. We will return your search via email.

  • The CON29O search form includes a section for optional enquiries, for example the location of pipelines and public footpaths, and parking restrictions. Optional Enquiries may be submitted with your standard search enquiry or separately. There is an additional fee of £10.00 for each Optional Enquiry.

    The Register of Common Land and Town and Village Greens

    We hold records of the town and village greens in Birmingham. A search of the Register of Common Land and Town and Village Greens can be made by requesting Optional Enquiry 22 on form CON29O. The fee for this request is £10.00.

  • Planning information is now available via a new mapping system on our Planning History page. The information includes the following and can help answer some of the planning questions on the CON29 form.

    • Enforcement Notices, Stop Notices, Breach of Condition Notices, Planning Contravention Notices

    A Personal Search of the Land Charges Register can be obtained via email from our Land Charges Team, there is no charge.

Frequently Asked Questions
    • The search fee for both residential and commercial searches of one unit of property or parcel of land is £22.00 for the  LLC1 reply and £78.00 for the CON29 forms .  Each part can be requested on its own.
      The fee for more than one property or parcel of land is £20.00 for each additional parcel.

      Optional enquiries fee: £10.00 for each question

      The CON29O form includes optional enquiries, for example the location of pipelines and public footpaths, and parking restrictions. Optional Enquiries may be submitted with your standard search enquiry or separately.

      Search the Register of Common Land and Town and Village Greens: £10.00

      This enquiry is now Optional Enquiry 22 on the CON29O form, but can be submitted on its own.

      Discussions are currently taking place with HMCR to charge Vat on the CON29 - once a decision has been made the fee will be amended in line with the current VAT rate.

    • We aim to reply to standard residential searches within 5 working days. Industrial premises and areas of land can take longer.

    • For a property or a site with a numbered postal address it is not essential to submit a plan with your search enquiry, but it is always advisable to submit one, to ensure accuracy. For all other property, you must submit a plan.

    • Copies of documents revealed in a search can be obtained from Local Land Charges and will usually be returned within 2 days.
