Protection of Property Service


What services do you provide?

The Adults and Communities Directorate has a statutory duty to protect property under certain circumstances. Protection can be provided for moveable property when the owner has to go into hospital or a care home (including a care home with nursing) or is made the subject of a Place of Safety Order. The Local Authority must be clear that the property is at risk or in danger, and that no other person is able to act.

Buildings can be secured, which means taking reasonable steps such as locking doors and shutting windows. If valuables such as cash, jewellery, or antiques have been left in a property, or pets have been left alone, then further action may be necessary. Permission from the owner must be sought to enter the property, except where the person is unable to give it due to reasons of ill-health.

The usual practice is for a member of the Adults and Communities Directorate's Protection of Property Team and a Social Worker to enter the premises and carry out any action necessary to protect the property, making sure that the owner's best interests are met.


How do I get the service?

To get a service from us, you must be in hospital, a care home or care home with nursing, or on a Place of Safety Order.


Is there a charge for this service?

There is no initial charge for the protection of property service.

However, if repairs need to be made or, for example, locks have to be fitted, or repairs are needed to keep the property safe and secure, a charge can be made. There may also be a small charge if we need to bank the property owner's cash or cheques, or store their property.

What standards can I expect?

The Adults and Communities Directorate's Protection of Property Team aims to provide a quality service based on the following standards:

  • Choice - If you need to go into hospital, residential or nursing home care, and your family, friends or neighbours are unable to look after your property, then you can ask Adults and Communities to do so.

  • Sensitivity - If you wish us to protect your property, then access to your property, or any information about you, will not be given without your consent.

  • Reliability - The Directorate will take reasonable steps to protect your property while you are away. (This means taking the same precautions that you would yourself if, for example, you were going away on holiday). Keys will be given back to you when you are able to return home.

  • Amount of Service - Every effort will be made to ensure that all doors and windows are secure, that electricity, gas, and water are turned off, and that water tanks are drained in winter. Valuable items removed to a safe place.
